What does California law currently allow today?
California is currently one of the more cannabis & home-grower-friendly states in the U.S. Today’s laws allow residents several privileges:
- Adults 21+ can legally possess, buy and germinate marijuana seeds.
- Home cultivation is permitted: up to 6 plants per residence for personal use (medical patients may have additional allowances in some cases).
- Plants must be grown in a secure, private space not visible from public areas.
- You can purchase seeds from licensed California dispensaries, nurseries or reputable online seed banks that ship to/within the state.
- Gifting small amounts (including marijuana seeds) to other adults is also allowed under Prop 64.
State law prioritizes personal freedom for responsible adult use. Nothing in the current or proposed regulations bans cannabis seeds or home growing in California.
Could the proposed federal legislation change anything?
A federal provision known as Section 781 (part of the FY2026 Agriculture Appropriations Act) is scheduled to take effect on November 12, 2026. It redefines “hemp” so that viable marijuana seeds capable of producing plants with more than 0.3% total THC (including THCA) would no longer qualify for hemp protections under the 2018 Farm Bill.
It’s important to note that this is not a ban on cannabis seeds in legal states like California. Instead, it primarily targets:
- Imports from overseas (including Europe).

- Commercial distribution and banking/payment processing for high-THC genetics.

The proposed new rules focus on federal compliance for breeders, importers and shippers - not on California residents growing a few plants at home for personal/medical consumption.
Possession and personal use (within California’s limits) should continue to be protected by state law. However, Cali growers may no longer be able to buy cannabis seeds online from Europe and they may struggle to even buy seeds from other states.
Will cannabis seeds still be legal in California?
Yes. The proposed federal change does not outlaw marijuana seeds that are already legal under California law. However, it could create practical difficulties for growers trying to buy cannabis seeds online from European or out-of-state suppliers:
- Reduced availability of imported genetics (especially popular Dutch and European cannabis seed varieties).

Will California growers still be able to buy Dutch and European genetics?
This is the area with the most uncertainty. Dutch Passion and other European breeders have been popular with American growers since the 1980’s. However, after November 2026, assuming the legislation is fully adopted:

5. Buy from established, reputable seed banks that prioritize quality and customer service.
6. Some growers are buying a few packs of regular seeds for long term storage- just in case they ever need to produce a few hundred cannabis seeds of their own from a future breeding experiment.
7. Watch out for any nearby cannabis or hemp farmers markets. Seeds can often be found for sale.
