What the new federal cannabis seed law actually says

Under the 2018 Farm Bill, cannabis seeds were generally treated as legal hemp seeds because the seeds themselves contain almost no THC. That allowed them to be sold and shipped across much of the USA. The new law changes everything. Instead of looking only at the THC content of the seed itself, the amended definition considers whether the seed is capable of producing a plant that exceeds 0.3% total THC (including THCA). Exactly how strictly this will be enforced is still unclear. Will seized seeds be grown by the authorities to assess their THC potential? Or, more likely, will they be seized on the presumption of high THC potential?  The chances of meaningful amendments or court challenges before the November 2026 deadline are now extremely small.
